Terms of Service

1. Agreement

These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," or "user") and Drains Fix — a brand owned and operated by Nova Buzz Digital Media Marketing Inc. ("Drains Fix," "we," "us," or "our") — governing your access to and use of our website at drainsfix.com, our phone coordination service at (438) 808-0511, our online forms, and any related features (collectively, the "Service").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Drains Fix is — and is not

Drains Fix is a bilingual customer-service and coordination platform. We answer phones, intake plumbing situations, triage by urgency, and connect users with independent third-party plumbing professionals operating in Greater Montreal.

Drains Fix is not a licensed plumbing contractor. Drains Fix does not perform any plumbing work, repairs, installations, inspections, diagnostics, or any other physical labour. We do not employ the plumbing professionals we connect you with; they operate as independent third parties.

3. Independent professionals

The plumbing professionals dispatched through Drains Fix are independent contractors. Each is solely and exclusively responsible for:

• Holding and maintaining all required licenses, permits, certifications, and insurance under Quebec and Canadian law;
• The methods, materials, equipment, and techniques used on any job;
• The quality, workmanship, completeness, and code-compliance of any work performed;
• Any warranty, guarantee, or service commitment they offer to you;
• Their own pricing, invoicing, payment processing, and tax compliance;
• Their own staff, vehicles, conduct, and on-site safety practices;
• Any damage, loss, injury, defect, or other outcome that arises from their work.

Any contractual relationship for the actual plumbing work — including price, payment, scope, warranty, and dispute resolution — is strictly between you and the independent professional. Drains Fix is not a party to that contract.

4. No advice; estimates only

Information provided by Drains Fix coordinators (over the phone, by email, or through this website) is general in nature and is not professional, technical, legal, or engineering advice. Estimates given before on-site inspection are preliminary; final pricing and scope are determined by the dispatched professional after they evaluate the situation in person, and you must approve before any chargeable work begins.

5. Disclaimer of warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permitted by applicable law. Drains Fix expressly disclaims all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, timeliness, and uninterrupted availability.

Without limiting the foregoing, Drains Fix makes no warranty, representation, or guarantee regarding:

• The qualifications, conduct, performance, availability, or timeliness of any independent professional;
• The quality, durability, code-compliance, or fitness of any work performed;
• The accuracy of any estimate, dispatch window, or response time stated;
• That the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitation of liability

To the maximum extent permitted by applicable law, Drains Fix and Nova Buzz Digital Media Marketing Inc., together with their officers, directors, employees, agents, suppliers, and affiliates, shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation damages for loss of profits, revenue, data, goodwill, business opportunities, property damage, water damage, personal injury, emotional distress, or any other intangible loss — arising out of or related to:

• Your use of, or inability to use, the Service;
• Any work performed (or not performed) by an independent professional dispatched through the Service;
• Any advice, estimate, scheduling, or communication provided by a Drains Fix coordinator or by an independent professional;
• Any delay, failure, defect, or harm of any kind related to a coordinated job;
• Any third-party content, link, or service accessed through the Service.

This limitation applies regardless of the legal theory invoked (contract, tort, strict liability, statute, or otherwise) and even if Drains Fix has been advised of the possibility of such damages. Where applicable law does not permit a complete exclusion of liability, Drains Fix's aggregate liability to you for any and all claims relating to the Service is limited to the greater of (a) the total amount you paid directly to Drains Fix in the twelve (12) months preceding the claim (which, for most users, will be zero), or (b) one hundred Canadian dollars (CA$100).

7. Indemnification

You agree to defend, indemnify, and hold harmless Drains Fix, Nova Buzz Digital Media Marketing Inc., and their officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any third-party right, including any privacy or intellectual-property right; or (iv) any dispute between you and an independent professional.

8. Acceptable use

You agree not to:

• Use the Service for any purpose that is unlawful, fraudulent, or harmful to others;
• Submit false, misleading, or impersonating information through any of our forms or phone calls;
• Interfere with or disrupt the Service, including by sending automated requests, bots, or spam;
• Attempt to gain unauthorized access to any part of the Service or to systems connected to it;
• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service;
• Use the Service to harass, abuse, or harm any independent professional, coordinator, or other user.

9. Intellectual property

All content on the Service — including text, logos, graphics, layouts, code, and the Drains Fix and Nova Buzz brands — is the property of Nova Buzz Digital Media Marketing Inc. or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent, except as expressly permitted by law (e.g., for personal, non-commercial reference).

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, share, and protect your personal information. By using the Service, you consent to our handling of personal information as described in that policy.

11. Third-party links and services

The Service may contain links to third-party websites or integrate with third-party services (e.g., Google Maps, Google Analytics). We are not responsible for the content, privacy practices, or terms of any third-party site or service. Your interactions with third parties are governed by those parties' own policies.

12. Modifications to the Service or these Terms

We may modify the Service or these Terms at any time, in our sole discretion. Material changes will be communicated by posting an updated version with a new "Last updated" date and, where appropriate, by additional notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including for violation of these Terms, with or without notice. The provisions of Sections 5 (Disclaimer), 6 (Limitation of Liability), 7 (Indemnification), 9 (Intellectual Property), and 14 (Governing Law and Jurisdiction) survive termination.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts of the District of Montreal, Quebec, and you consent to the personal jurisdiction of those courts. Where required by applicable consumer-protection law, mandatory rights granted to you under such laws are not displaced by this section.

15. Severability and waiver

If any provision of these Terms is found to be unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Drains Fix regarding the Service and supersede all prior agreements, communications, and understandings on that subject.

17. Language

These Terms have been drafted in English and translated into French. In the event of any inconsistency between the two versions, the English version prevails to the maximum extent permitted by applicable law.
